The U.S. Court of Federal Claims has recently ruled in favor of a child alleged to have regressed into autism as a result of vaccine administration. The government’s concession was filed November 9, 2007 and sealed to protect the plaintiffs identity until February 2008.
While the Department of Health and Human Services division of Vaccine Injury compensation (or DVIC) continues to deny the link between vaccines and autism, the Federal Court and taxpayers are providing for care for children stricken with autism following vaccinations. David Kirby, writing for the Huffington Post, publishes the direct wording of the ruling. A brief summary of the care:
The child showed normal development, except for persistent ear infections, until a visit to the Pediatrician and the administration of 5 vaccines during one visit. After that visit, the child was inconsolable, had severe fevers, loose stools and regressed developmentally. Finally, three months following the vaccinations was diagnosed with “regressive encephalopathy with features consistent with an autistic spectrum disorder, following normal development."
“DVIC has concluded that the facts of this case meet the statutory criteria for demonstrating that the vaccinations the child received, significantly aggravated an underlying mitochondrial disorder, which predisposed her to deficits in cellular energy metabolism, and manifested as a regressive encephalopathy with features of autism spectrum disorder.”
